Voter Terms of Service

1. About VoteAmerica
VoteAmerica is a nonpartisan, nonprofit organization incorporated in California. Our mission is to increase voter turnout across the United States. We build tools and services that guide citizens through every step of the voting process—from pre-registration through casting a ballot.
When we say "VoteAmerica," "we," "us," or "our," we mean VoteAmerica and VoteAmerica Action Fund.
When we say "you" or "user," we mean anyone who visits our websites or uses any of our software applications and digital tools (collectively, the "Services").
2. About These Terms
These Terms of Service ("Terms") explain the rules and expectations for using our Services. They apply to all users, including users under 18. Please read them carefully.
By using our Services, you are agreeing to these Terms. If you do not agree with any part of these Terms, you should not use our Services.
3. Who Can Use Our Services
You may use our Services if you:
- Are a U.S. citizen;
- Are at least 13 years old;
- Have the legal authority to enter into these Terms; and
- Use the Services in compliance with these Terms and all applicable laws.
Some features—including making donations—are only available to users who are 18 or older.
If you are between 13 and 17 years old, you can still use our voter registration and pre-registration tools. We encourage you to involve a parent or guardian.
4. Your Responsibilities
4.1 Accurate Information
To use some of our Services, you may need to:
- Provide your real name and accurate information;
- Keep your information up to date; and
- Keep your login credentials (if applicable) secure.
4.2 Prohibited Conduct
You agree not to:
- Impersonate another person or misrepresent your identity;
- Use our Services to violate any law or regulation;
- Interfere with or attempt to disrupt our systems, networks, or other users;
- Post or transmit harmful, illegal, or misleading content;
- Share another person's private information without their permission;
- Attempt to access non-public areas of our Services; or
- Distribute spam, malware, or unauthorized advertisements.
4.3 Device Security
You may only use our Services on devices that you own or control and that are free of malware. Devices that have been "jailbroken" or otherwise modified to circumvent security controls may not be used. When accessing our Services remotely, use a known, secure wireless connection or a cellular network. Do not access our Services over unknown or unsecured wireless access points.
5. Communications
5.1 General Communications
By using our Services and providing your contact information, you agree that we may contact you via email, text message (SMS), phone call, or within the platform, depending on the information you provide and the choices you make.
5.2 Text Messaging (SMS)
If you provide your phone number, we may send you election reminders and voting-related updates via text message. By providing your mobile number and opting in, you consent to receive recurring messages from VoteAmerica. Please note:
- Message frequency will increase as elections approach.
- Standard message and data rates may apply.
- You can stop receiving texts at any time by replying STOP.
- To get help, reply HELP or email us at legal@voteamerica.org.
- We do not share your SMS opt-in data or consent with any third parties.
We are not responsible for delayed or undelivered messages due to factors outside our control.
6. Donations
Donations to VoteAmerica support our mission of increasing voter participation across the United States. Unless otherwise specified in a grant agreement, donations are unrestricted and used at our discretion. Donations may only be made by users who are 18 or older.
7. Intellectual Property
All content, tools, branding, and technology on or within our Services are owned by VoteAmerica or our licensors and are protected by applicable intellectual property laws. You may use our Services and their content for your own personal, noncommercial purposes, but you may not copy, sell, or redistribute them without our prior written permission.
8. Third-Party Links and Services
Our Services may contain links to third-party websites or tools. We are not responsible for the content, accuracy, or privacy practices of those sites. Use them at your own risk and review their terms and privacy policies before providing any information.
9. Disclaimer of Warranties
We do our best to provide accurate and helpful information. However, our Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that our Services will be error-free, uninterrupted, or secure.
10. Limitation of Liability
To the fullest extent permitted by law, VoteAmerica and its employees, directors, and officers are not responsible for any indirect, incidental, consequential, or punitive damages arising from your use of our Services, including lost profits, lost data, or personal injury. Your sole remedy if you are dissatisfied with our Services is to stop using them.
11. Indemnification
You agree to defend, indemnify, and hold harmless VoteAmerica and its employees, directors, and officers from any legal claims, damages, liabilities, or expenses (including reasonable attorneys' fees) arising from your use of our Services or your violation of these Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. You agree to resolve any dispute with VoteAmerica through binding arbitration in San Francisco, California, except that either party may bring eligible claims in small claims court.
13. Additional Legal Provisions
13.1 No Assignment
You may not assign your rights or obligations under these Terms without VoteAmerica's prior express written consent.
13.2 Severability
If any provision of these Terms is found to be unenforceable, that provision will be construed as narrowly as possible to reflect the original intent, and the remaining provisions will continue in full force and effect.
13.3 No Waiver
VoteAmerica's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other right.
14. Changes to These Terms
We may update these Terms from time to time. All changes are effective immediately upon posting. Your continued use of our Services after changes are posted constitutes your acceptance of the updated Terms. The "Last updated" date at the top of this document will always reflect when the most recent changes were made. We encourage you to review these Terms periodically.
