Customer Privacy Policy

This is the privacy policy for VoteAmerica Plus customers. If you are a voter, please reference the Voter Privacy Policy.
VoteAmerica LLC (d/b/a VoteAmerica+ and VoteAmericaPlus) is a company dedicated to increasing voter turnout in US elections. VoteAmerica LLC is referred to below as "VoteAmerica," "we," "our," or "us."
This Customer Privacy Policy applies specifically to organizations and individuals ("Customers") who create accounts and license the VoteAmerica software and APIs ("Services"). It describes how we collect, use, and protect information about you in your capacity as a Customer.
By creating an account or using the Services, you agree to this Privacy Policy, as well as our Terms of Service, our Acceptable Use Policy, and our Community Standards.
We may update this Privacy Policy at any time by posting a revised version and updating the "Last Updated" date above. We may also notify you of material changes by email. Your continued use of the Services following any update constitutes your acceptance of the revised policy.
1. Information We Collect About Customers
1.1 Information You Provide to Us
We collect information you provide directly when you create an account or use the Services, including:
- Account information, such as your name, organization name, email address, and password;
- Contact information, such as your mailing address and phone number;
- Billing information, such as payment method details (processed by our third-party payment processor — see Section 1.3 below); and
- Communications, such as support requests, feedback, or other correspondence you send us.
1.2 Information We Collect Automatically
When you access the Services, we may automatically collect:
- Device and browser information, such as IP address, browser type, operating system, and device identifiers; and
- Usage information, such as pages viewed, features used, and actions taken within the Services.
1.3 Payment Processing
All payments are processed by a third-party payment processor. We do not collect or store your credit card or banking information. Payment data is subject to the payment processor's own privacy policy and security practices.
1.4 Cookies and Similar Technologies
We use cookies and similar technologies (such as pixels and web beacons) to operate the Services, remember your preferences, and analyze usage. You can configure your browser to reject cookies, though this may affect certain features of the Services.
We currently work with the following third parties that may collect information via cookies:
- Squarespace Analytics (analytics)
- Google Analytics (analytics)
- Sentry (error tracking)
2. How We Use Customer Information
We use the information we collect about Customers to:
- Provision and manage your account and access to the Services;
- Process payments and maintain billing records;
- Provide customer support and respond to inquiries;
- Send you notices about your account, including policy updates and service announcements;
- Improve, enhance, and develop the Services;
- Detect and protect against security incidents, fraud, or unlawful activity;
- Comply with legal and regulatory obligations; and
- Market the Services to you, where permitted by applicable law.
We may aggregate and anonymize Customer information so that it can no longer be reasonably linked to a specific individual or organization, and may use and disclose such data for any purpose.
3. Voter Data Accessed Through the Services
As a Customer, you may have access to voter data collected through your instance of the Services ("Voter Data"), including names, addresses, dates of birth, email addresses, and phone numbers of voters who use your VoteAmerica+-powered tools.
3.1 Co-Ownership
VoteAmerica and Customer co-own Voter Data collected through Customer's instance of the Services.
3.2 Prohibition on Sale
Voter Data may never be sold, rented, leased, or otherwise transferred to any third party in exchange for monetary compensation or any other consideration. This prohibition applies to Voter Data in any form — raw, aggregated, anonymized, or otherwise. Violation of this prohibition constitutes a material breach of the Terms of Service and will result in immediate termination of your account without refund.
3.3 Restrictions on Use
Customer may use Voter Data only for legitimate voter mobilization purposes and in accordance with all applicable privacy laws. Customer may not share Voter Data with third parties except as strictly necessary to carry out those purposes, and only under confidentiality and data protection obligations at least as protective as those in this Policy and the Terms of Service.
3.4 Customer's Own Privacy Policy
If you embed the Services on your website, your website must include a clearly visible link to your own current and accurate privacy policy that describes how Voter Data and other personal information collected through the embedded Services will be used.
4. How We Disclose Customer Information
We may disclose Customer information to third parties as follows:
Service Providers. We share information with third-party vendors who help us operate our business, including cloud providers, analytics providers, and security vendors. We require such vendors to use your information only for authorized purposes and to protect it to at least the same standards we apply.
Professional Advisors. We may share information with auditors, accountants, or lawyers as necessary.
Authorities and Law Enforcement. We may disclose information to protect the legal rights, safety, or security of VoteAmerica, or as required by law. We will not disclose individual-level information to law enforcement unless we believe in good faith that disclosure is legally required.
Affiliates. We may share information with our parent company, VoteAmerica, Inc., and other affiliates for the purposes described in this Policy.
Business Transfers. We may share information in connection with a merger, acquisition, sale of assets, or similar transaction.
We do not sell Customer information to third parties.
5. Your Privacy Choices
Marketing Communications. You may opt out of marketing emails at any time by following the unsubscribe instructions in those emails or by emailing privacy@voteamericaplus.org with the subject line "Email opt-out request." You will continue to receive service-related communications such as policy updates and account notices.
Cookies. You can disable or limit cookies through your browser settings. See USA.gov for more information on managing cookies.
Do Not Track. We do not currently recognize or respond to automated browser "Do Not Track" signals.
6. Information Security
We implement reasonable administrative, technical, and physical safeguards to protect Customer information from unauthorized access, disclosure, alteration, or destruction. However, no method of internet transmission or electronic storage is completely secure, and we cannot guarantee absolute security. To the extent permitted by applicable law, we assume no liability for loss or unauthorized disclosure of information due to causes beyond our reasonable control.
7. Information Retention
We retain Customer information for as long as your account is active, and for a reasonable period thereafter as necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce our agreements.
8. California Residents
If you are a California resident, you may have the following rights under the California Consumer Privacy Act ("CCPA"):
- Right to Know: Request access to the personal information we have collected about you and how we have used or shared it.
- Right to Delete: Request deletion of personal information we hold about you, subject to certain exceptions.
- Right to Correct: Request correction of inaccurate personal information.
- Right to Opt-Out: Request to opt out of the sharing of your personal information for targeted advertising purposes.
- Right to Nondiscrimination: You will not be discriminated against for exercising any of your California privacy rights.
We do not sell Customer personal information as that term is construed under California law.
To exercise any of these rights, please email privacy@voteamericaplus.org with the subject line "California Privacy Request." We will verify your identity before taking action.
9. Other U.S. State Privacy Rights
If you reside in a state with a comprehensive privacy law in effect (such as Colorado, Connecticut, Utah, or Virginia), you may have additional rights, including the right to access, correct, or delete your personal information, and the right to opt out of targeted advertising or automated decision-making. To exercise these rights, email privacy@voteamericaplus.org with the subject line "Privacy Request."
10. Geographic Restriction
The Services are hosted in the United States and are intended for use by United States-based organizations. If you are accessing the Services from outside the United States, please note that your information will be transferred to and processed in the United States.
