Acceptable Use Policy

This Acceptable Use Policy ("Policy") applies to your organization's use of the VoteAmerica software and APIs ("Services"), which have been made available to you via VoteAmerica LLC (d/b/a VoteAmericaPlus). VoteAmerica and VoteAmerica LLC are separate entities. VoteAmerica is a registered 501(c)(3) nonprofit corporation; VoteAmerica Plus is a wholly owned subsidiary of VoteAmerica. "VoteAmerica" when used in this Policy refers to both VoteAmerica LLC and VoteAmerica.

By creating an account or logging into the Services, you agree to be bound by this Policy, the Terms of Service, and our Community Standards (collectively, the "Terms").


1. Changes to This Policy

VoteAmerica may update this Policy at any time by posting a revised version at https://voteamericaplus.org/acceptable-use-policy. Updates are effective upon posting.


2. Violations

Any violation of this Policy will be considered a material breach of the Terms of Service and any other agreement governing your use of the Services, and may result in immediate suspension or termination of your account without refund.


3. Prohibited Material

You may not, and may not allow any third party, including your users, to use the Services to display, store, process, or transmit:

  • Material that infringes or misappropriates a third party's intellectual property or proprietary rights;
  • Hate-related or violent material, or material advocating discrimination against individuals or groups;
  • Obscene, excessively profane, or otherwise objectionable material;
  • Material advocating or advancing criminal hacking, cracking, or phishing;
  • Malicious material, including material that supports or facilitates unlawful, hateful, discriminatory, or violent causes;
  • Unlawful software;
  • Malicious code, such as viruses, worms, time bombs, Trojan horses, or other harmful or malicious files, scripts, agents, or programs; or
  • Material that violates, encourages, or furthers conduct that would violate any applicable local, national, or international laws or regulations, including any criminal laws, or any third-party rights, including publicity or privacy rights.

4. Prohibited Actions

You may not use the Services, nor allow your users or any third party to use the Services, to:

4.1 Spam and Unsolicited Communications

  • Generate or facilitate unsolicited commercial email (spam), including sending communications in violation of the CAN-SPAM Act or any other applicable anti-spam or privacy law;
  • Imitate or impersonate VoteAmerica, another person, or create false accounts for the purpose of sending spam;
  • Data mine or harvest any web property to find email addresses or other account information;
  • Send unauthorized email via open, third-party servers;
  • Send email to users who have requested to be removed from a mailing list;
  • Sell, exchange, share, or distribute personal information, including email addresses, to any third party without such person's knowing and continued consent; or
  • Send unsolicited emails to individuals or entities with whom you have no preexisting relationship, or otherwise contrary to anti-spam or privacy laws.

4.2 Mobile Messaging

Generate or facilitate SMS, MMS, or other text messages or push notifications in violation of the Telephone Consumer Protection Act ("TCPA"), the Do-Not-Call Implementation Act, or any other applicable telemarketing or telephone consumer protection laws or regulations.

4.3 Privacy and Data Protection

  • Violate or facilitate violation of applicable data protection, privacy, or electronic communications laws; or
  • Violate the Mobile Messaging Consent Policy described in Section 5 of this Policy.

4.4 Harmful and Illegal Content

  • Conduct or forward multi-level marketing, such as pyramid schemes;
  • Send, upload, distribute, or disseminate unlawful, defamatory, harassing, abusive, fraudulent, infringing, obscene, excessively profane, hateful, violent, or otherwise objectionable material, or promote, support, or facilitate unlawful, hateful, discriminatory, or violent causes;
  • Illegally transmit another's intellectual property or other proprietary information without such owner's or licensor's permission;
  • Transmit materials that may be harmful to minors;
  • Promote, facilitate, or encourage illegal activity;
  • Violate the rights of others, including rights of privacy or publicity;
  • Impersonate another person, entity, or VoteAmerica, or otherwise misrepresent yourself or the source of any communication;
  • Engage in activity in connection with illegal peer-to-peer file sharing;
  • Engage in or promote gambling or run a gambling operation; or
  • Intentionally distribute viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other items of a destructive or deceptive nature.

4.5 Security and System Integrity

  • Use the Services in any way designed or used to commit or facilitate any phishing attack;
  • Introduce keystroke logging or any other monitoring code into the Services;
  • Operate any open proxy or other Internet proxy service capable of forwarding requests to any end user or third-party supplied Internet host;
  • Attempt to probe, scan, or test the vulnerability of a Services-related system, or breach any security or authentication measures, or perform any security integrity review, penetration test, load test, denial of service simulation, or vulnerability scan on any Services-related system or network;
  • Take any action that imposes an unreasonably or disproportionately large load on our infrastructure, or otherwise interfere with or disrupt the Services;
  • Jeopardize the security of your Services account or anyone else's account; or
  • Interfere with security-related features of the Services, including by removing, disabling, circumventing, or otherwise creating any workaround to any copy protection, rights management, or security features.

4.6 Intellectual Property and Reverse Engineering

  • Remove any copyright, trademark, or other proprietary rights notices contained in or on the Services, or reformat or frame any portion of the Services' administration display;
  • Modify, translate, adapt, or otherwise create derivative works or improvements of the Services or any content or source code;
  • Use or develop any third-party applications that interact with the Services or others' content without our prior written consent; or
  • Decompile, reverse engineer, or otherwise attempt to derive or gain access to the source code or underlying ideas or information relating to the Services without our prior written consent.

4.7 Web Scraping

Access any third-party web property for the purposes of web scraping, web crawling, web monitoring, or other similar activity through a web client that does not take commercially reasonable efforts to identify itself via a unique User Agent string and obey the robots exclusion standard (robots.txt), including the crawl-delay directive.

4.8 Industry Standards

Violate any applicable industry standards, third-party policies, or requirements that VoteAmerica may communicate to its users, including guidelines published by the CTIA, the Mobile Marketing Association, the Digital Advertising Alliance, the Network Advertising Initiative, or any other generally accepted industry associations or carrier guidelines.

4.9 Disparagement

Use the Services in any manner that would disparage VoteAmerica or its affiliates.

4.10 Inconsistent Use

Transmit any content or otherwise use the Services in a manner that is inconsistent with the Statement of Purpose contained in the Terms of Service.


You are responsible for ensuring that all phone numbers and other personal information provided to VoteAmerica have been collected in accordance with the TCPA, including ensuring that you have appropriate consent to send text messages to users.

You shall comply with all statutory and regulatory obligations and relevant codes of practice relating to text messaging, including:

  • All text messages shall be sent only to recipients who have given their consent to receive such messages, or where you have another valid legal basis under applicable law; and
  • You shall honor unsubscribe requests from anyone who no longer wishes to receive text messages from you.
